Memoralise Pty Ltd (“Memoralise”, “we”, “us”) does not sell, rent, trade, or otherwise disclose your personal information to third parties for monetary or other valuable consideration. We never have and we never will.

This commitment applies to all categories of personal information we collect, including account information, usage data, and any other data associated with your use of our Service.

What Does “Sale” Mean Under the CCPA?

The California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), defines a “sale” broadly as disclosing, making available, or transferring a consumer’s personal information to a third party for monetary or other valuable consideration. The CPRA also introduces the concept of “sharing,” which covers disclosing personal information for cross-context behavioural advertising purposes.

Memoralise does not engage in either practice. We do not disclose your personal information to third parties for advertising, marketing, or any form of compensation.

Our Zero-Knowledge Architecture

Memoralise employs a zero-knowledge encryption architecture for vault data. This means that your most sensitive information — the documents, messages, and files you store in your vault — is encrypted with keys that we do not possess. We cannot access, read, or share your vault data because we are technically unable to do so.

For non-vault data (such as your account email and name), we use this information solely to provide the Service and do not disclose it to third parties except as strictly necessary to operate the platform (e.g., payment processing via Stripe, identity verification via AU10TIX). These disclosures are for service provision, not “sales” under the CCPA/CPRA.

Submit an Opt-Out Request

Although we do not sell or share your personal information, we respect your right to submit a formal opt-out request under the CCPA/CPRA. You may use the form below or contact us directly at privacy@memoralise.com.

Your Rights

As a California resident, you have the right to:

• Request that we disclose the categories and specific pieces of personal information we have collected about you.
• Request that we delete personal information we have collected from you.
• Opt out of the sale or sharing of your personal information (which, as stated above, we do not engage in).
• Not be discriminated against for exercising any of your privacy rights.

We will respond to verifiable consumer requests within 45 days, as required by law. For requests that require additional time, we will notify you of the extension and the reason for it.
